Thailand Market Access for Telecom Approval 

 

The National Broadcasting and Telecommunications Commission (NTC or NBTC) is an independent state telecommunications regulator in Thailand. Its duties and responsibilities are to regulate all telecommunication services in the country through formulating a Master Plan on Telecommunications Activities, permitting and regulating the use of spectrum for telecommunication services, and granting licenses to the telecommunications operators.

 

Telecommunication equipment in scope of the NBTC approval is divided into 3 groups with different types of Conformity Assessment Procedures:

 

  • Class A requires Registration. Class A equipment is the telecommunication equipment, for which a supplier has to demonstrate its conformity against the prescribed technical standard or technical requirement by testing. The procedureis  performed by a laboratory designated by theNBTC. Then the equipment has to be registered with the Office of the NBTC. This class includes certain land mobile radiocommunication equipment, satellite communication equipment, and some RFID equipment.

  • Class B requires Certification. Class B equipment is the telecommunication equipment, for which a supplier has to demonstrate its conformity against the prescribed technical standard or technical requirement by testing. The procedure is performed by a laboratory designated by the NBTC. Then the equipment has to be certified by the Office of the NBTC. This class includes cellular radiocommunication equipment, broadband wireless access equipment, amateur radiocommunication equipment, certain land mobile radiocommunication equipment, and maritime radiocommunication equipment, including also digital TV and internet set-top box.

  • SDoC. In case when the NBTC had prescribed technical standard or technical requirements for the equipment, but doesn’t require such equipment to be registered or certified, a supplier has an obligation to provide written confirmation that the equipment conforms to such standard or technical requirement using Supplier’s Declaration of Conformity (SDoC) form.

 

In order to process these three classes, importer will also need to obtain the NBTC seller license and the NBTC four-digit supplier code.

 

Supplier has the obligation to show the NBTC’s mark of conformity by (1) affixing the label on the telecommunication equipment, also (2) compliance sentences and (3) the QR Code and the label notice for the radio communication equipment. All labels must be purchased from the NBTC and cannot be self-printed.

 

Labelling requirements 

 

1. Labelling

 

Label example for Class A equipment:

where YYYYYY is registration number (6 digits)

ZZ is the year of registration (last 2 digits of the year)

XXXX is supplier code (4 digits)

 

 

Label example for Class B equipment:

where AAAAAA is certification number (6 digits)

BB is the year of certification (last 2 digits of the year)

XXXX is supplier code (4 digits)

 

Label should be affixed on equipment, and shall be easily legible, visible and cannot be easily removed. In case where label cannot be properly placed on the equipment (e.g. the equipment size is too small), the label shall be shown on the materials that come with the equipment (e.g. package or user manual). 

 

2. Compliance sentences

 

A supplier has an obligation to provide compliance wording (stating compliance with the NBTC technical standard or technical requirement) in the user’s manual, package or additional sheet inside packaging or electronic displaying on the product screen (For Class A and Class B, it is mandatory to display this marking. For SDoC, it is recommended to display), using the following text:

 

Warning for technical standard conformity

 

 

“เครื่องโทรคมนาคมและอุปกรณ์นี้ มีความสอดคล้องตามมาตรฐานหรือข้อกำหนดทางเทคนิคของ กสทช.”

 

Translation: This telecommunication equipment conforms to the standard or technical requirements of the NBTC

 

 

Warning regarding safety to human health

 

“เครื่องวิทยุคมนาคมนี้มีอัตราการดูดกลืนพลังงานจําเพาะ (Specific  Absorption Rate - SAR) อันเนื่องมาจากเครื่องวิทยุคมนาคมเท่ากับ ___W/kg  ซึ่งสอดคล้องตามมาตรฐานความปลอดภัยต่อสุขภาพของมนุษย์จากการใช้เครื่องวิทยุคมนาคมที่คณะกรรมการกิจการโทรคมนาคมแห่งชาติประกาศกําหนด”

 

Translation: This radio communication equipment has the specific absorption rate (SAR) of ___ W/kg as related to the equipment, which is in compliance with the Safety Standard for the Use of Radio communication Equipment on Human Health announced by the National Telecommunications Commission.

 

 

3. E-labelling  (QR code + label notice)

 

From March 6, 2019, all importers/distributors, who sell radiocommunication equipment must attach corresponding labels when they import their products to Thailand. The purpose of this label notice is to make a user aware whether these products will require to apply a user license or not. Local suppliers can put the marking under the NBTC permission to apply self-labeling either by printing or an electronic label. The permission for the e-label is issued for a local supplier and valid for 3 years.

 

There are 2 types of the labeling notice:

 

- A label notice for equipment which requires a user license (e.g. an UHF product, a Walkie talkie product)

Translation: Whoever possess or uses this radio communication equipment or sets up a radio communication station must receive a license from a license officer. In case of violation of section 6 or 11, the person will be subject to the penalty as per section 23 of Radio communication Act B.E. 2498, which includes a fine penalty not more than 100,000 baht or imprison not more than 5 years, or both.

 

- A label notice for equipment that is license exempted (e.g. WWAN, WLAN, NFC, WLAN, Bluetooth, WiGig)

 

 

Translation: This radio communication equipment is exempted to possess a license, a user license, or a radio communication station license as per the NBTC notification regarding the radio communication equipment and a radio communication station has been exempted for the license according to radio communication act B.E.2498.

 

The QR code label with the notice should be printed on a user manual shown on packaging or provided as an additional sheet put inside the packaging. The size is specified as 5 cmx5 cm.
